Item 194 - Frozen Pork from the European
        

1.0 purpose

1.1 the purpose of this notice is to inform importers of the rules and procedures governing the issuance of import permits for frozen pork from specific countries of the european union.

note: for the quota year 2011-2012, the tariff rate quota (trq) for frozen pork from specific countries of the european union (under tariff item no. 0203.29.00) will be accessible on monday, july 4, 2011 at 12:00 hrs (noon) eastern daylight time (edt). applications are permitted for shipments that will enter canada on or after august 1st 2011. any applications submitted prior to 12:00 hrs edt on monday, july 4, will be rejected.

2.0 coverage

2.1 this notice replaces notice to importers no. 766 dated may 12, 2010 and refers to item 194 of the import control list (icl). this item covers frozen meat of pork, falling under tariff item no. 0203.29.00 of the customs tariff.

3.0 duration

3.1 this notice may be amended or cancelled on short notice. if it is not amended or cancelled, this notice will remain valid until july 31, 2012.

4.0 authority

4.1 the product covered by this notice was added to the import control list (icl), pursuant to subsection 53(2) and section 79 of the customs tariff, under the european union surtax order.

5.0 import permit issuance

5.1 import permits are required for each shipment of frozen meat of pork, falling within tariff item no. 0203.29.00 of the customs tariff. importers may either invoke general import permit (gip) no. 100, a copy of which is available on request, or present an import permit issued to their firm for that shipment ("specific import permit"), in order to clear customs. the specific import permit must also be presented to canada border services agency (cbsa) at the time of accounting for the shipment to be eligible for the duty free rate provided under tariff item no. 0203.29.00. goods imported without a specific import permit (i.e., those invoking the gip) will be subject to the rate of duty provided under the european surtax order. note: specific permits will not be issued for shipments already imported into canada under the authority of the general import permit.

5.2 foreign affairs and international trade canada (dfait) has in place the following procedures for receiving applications for import permits:

(a) when requesting an import permit, applicants are required to complete the form ext-1466, "application for permit" (a copy of which is attached as appendix 1), and transmit it to dfait or to a customs broker.

(b) a description of the process of applying for an import permit is attached as appendix 2; it includes fees, monthly billing system and information required from applicants. all import permits are issued either through an on-line automated system in the offices of customs brokers in major centres across canada, or in the offices of dfait.

6.0 import access level

6.1 under the european union surtax order, the tariff rate quota (trq) level established for frozen meat of pork, for the twelve month period of august 1, 2011 to july 31, 2012 is 2,970,000 kilograms. it covers imports that originate in austria, belgium, denmark, finland, france, federal republic of germany, greece, ireland, italy, luxembourg, the netherlands, portugal, spain, sweden or the united kingdom of great britain and northern ireland.

6.2 imports in excess of 2,970,000 kilograms in any twelve month period commencing on august 1, 2011 to july 31, 2012 are made subject to a surtax in an amount equal to the value for the duty (100%) determined in accordance with sections 45 to 56 of the customs act, less the customs duty as calculated in accordance with the schedule to the customs tariff in respect of those goods.

6.4 dfait will grant import permits in order of receipt of permit applications (first-come, first-served), whether sent through customs brokers, by mail, by courier or by facsimile.

6.5 import permits will normally be issued with a validity period of 30 days around the date of arrival specified by importers (5 days prior to it and 24 days after). under no circumstances will utilization of permits for one quota year be allowed in the next quota year. requests for permits are normally accepted 30 days prior to the expected date of arrival of the shipment in canada. in order for permit applications to be received on a weekday, requests for permits for quota year 2011-2012 will be accepted monday, july 4, 2011 at 12:00 hrs edt. note: import permits will not be extended beyond the 30 days validity period.

6.6 for the quota year 2011-2012, the tariff rate quota (trq) for frozen pork from specific countries of the european union (under tariff item no. 0203.29.00) will be accessible on monday, july 4, 2011 at 12:00 hrs (noon) edt. applications are permitted for shipments that will enter canada on or after august 1st, 2011. any applications submitted prior to 12:00 hrs edt on monday, july 4, 2011 will be rejected.

6.7 quantities retrieved from the unused or expired permits (cancelled import permits) will be credited to the pork tariff rate quota falling under tariff item no. 0203.29.00 and redistributed to companies on a waiting list on a rotating container-by-container basis. applicants wishing to be on a waiting list must make a request in writing to lynn matthew/dfait when the trq is filled.

7.0 permit fees

7.1 a fee will be levied for each permit or certificate issued in accordance with the export and import permits and certificates fees order.
